Terms of Use

1. Acceptance of Terms

By accessing or using the Hashish protocol, the hash(ish) mobile mining application, or the hashish.fun website (collectively, the “Service”), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

These Terms apply in addition to the Privacy Policy, the open-source license, and any other policy linked from the Service. Where any conflict exists, the policy specific to the feature you are using prevails.

2. Description of the Service

Hashish is a decentralized Proof-of-Work token protocol deployed on the Solana blockchain. The Service includes:

  • On-chain smart contracts (pow_protocol, pow_treasury) that anyone may interact with permissionlessly.
  • The hash(ish) mobile application that mines on the Seeker pool via Solana Mobile Seeker hardware attestation.
  • The hashish.fun website which displays public on-chain statistics.

No fiat currency, securities, or investment products are sold, offered, or solicited through the Service. The HASH token is a utility token with no expectation of profit derived from the efforts of others.

3. Eligibility

You must be at least eighteen (18) years old, or the age of majority in your jurisdiction (whichever is greater), to use the Service. By using the Service, you represent and warrant that:

  • You have the legal capacity to enter into a binding agreement.
  • Your use of the Service does not violate any applicable law, regulation, or sanction in your jurisdiction.
  • You are not a resident of, or accessing the Service from, a jurisdiction in which using a decentralized cryptocurrency protocol is prohibited.

You are solely responsible for compliance with local law, including tax reporting on any HASH or SOL you receive from the Service.

4. Risks

You acknowledge and accept that:

  • Cryptocurrencies are volatile. The HASH token has no guaranteed value and may go to zero.
  • Mining rewards are not guaranteed. Block rewards decay over time per the on-chain emission schedule.
  • Smart contracts may contain bugs. Although the deployed programs have been independently verified by OtterSec, no audit eliminates all risk.
  • Mining consumes battery and CPU. Sustained operation may cause heat, throttling, or shorter device lifespan.
  • Mining requires SOL to pay protocol fees. SOL spent on fees is non-refundable regardless of mining outcome.
  • The Solana network may experience downtime, congestion, forks, or other events outside our control.

5. Wallet and Key Management

You alone are responsible for the safekeeping of your Solana wallet, seed phrase, and any session keys generated by the hash(ish) application. The Service is non-custodial: we do not store, hold, or have access to your private keys at any time.

Loss of your wallet means permanent loss of access to any HASH or SOL associated with it. We cannot recover lost keys.

6. Acceptable Use

You agree not to:

  • Reverse-engineer, modify, or attempt to circumvent the hardware attestation enforced by the Seeker pool, or any anti-abuse mechanism in the Service.
  • Use the Service to launder funds, finance illegal activity, or violate sanctions.
  • Attempt to disrupt, overload, or attack the Service infrastructure (RPC endpoints, attestation backend, public APIs).
  • Submit forged hardware attestations or any data intended to deceive the protocol’s integrity checks.
  • Use the Hashish branding, logos, or app signing key in a way that misrepresents your relationship with the project.

7. No Warranties

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or the accuracy of any data displayed.

The Hashish smart contracts are deployed open-source on Solana mainnet. Anyone may inspect, audit, or fork them. We make no warranty about future deployments, upgrades, or migrations.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will the developers, contributors, or operators of the Service be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, tokens, data, or use, arising out of or in connection with the Service.

Our total aggregate liability for direct damages will not exceed the greater of (a) the amount of fees you paid to the Service in the past twelve (12) months, or (b) one hundred euros (€100).

9. Open Source and Intellectual Property

The Hashish smart contracts and the hash(ish) mobile application are licensed under the terms set out on the /license page. The Hashish name, logo, leaf marks, and other brand assets remain the property of their respective owners. Forks and derivative works must remove or rename the Hashish branding.

10. Termination

We may suspend access to the website, the attestation backend, or the mobile application at any time, for any reason, with or without notice. The on-chain protocol cannot be terminated by us — it is permissionless and continues to operate independently of any centralized service.

You may stop using the Service at any time. Sections 4 (Risks), 7 (No Warranties), 8 (Limitation of Liability), and 12 (Governing Law) survive termination.

11. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Service after a change constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of France. Any dispute arising in connection with the Service that is not resolved informally will be subject to the exclusive jurisdiction of the courts of Paris, France, without prejudice to any mandatory consumer-protection rule that grants you a more favourable forum.
